Florida Community Property Trust: Stepping up your married client’s planning to obtain full basis step ups at first spouse’s death.
In 2021, Florida legislatively created the ability for married couples to receive community property treatment on certain assets using a Florida Community Property Trust. This presentation will cover a brief background on community property versus separate property systems, basis adjustments at death, what a Florida Community Property Trust is, what the potential benefits of such a trust are, and who might be good candidates for a community property trust.

Joe Cuffel is an attorney at Green Schoenfeld & Kyle, LLP. Joe practices in the areas of Wills, Trusts, Estate Planning, Taxation and Probate and Trust Administration.
Joe received his Bachelor's Degrees in Marketing and Real Estate from Florida State University in 2012. Joe received his Juris Doctor (J.D.) from Stetson University College of Law in 2020 and earned his Master of Laws in Taxation (LL.M.) from the University of Florida in 2021. Joe is a member of the Lee County Bar Association, the Real Property Probate and Trust Law Section of the Florida Bar, the Tax Section of the Florida Bar, the Planned Giving Council of Lee County and the Estate Planning Council of Lee County.
