Undue Influence - Don't Be A Defendant (Joint meeting with PGC)
This will be our annual joint meeting with the Planned Giving Council (formerly the Partnership for Philanthropic Planning). The program will address what Undue Influence is, the factors of Undue Influence the courts look for, where Undue Influence is applicable (Wills, Trusts, Beneficiary Designations, etc.), liability exposure for professionals, and strategies to avoid potential liability. There will be plenty of examples illustrating each point of discussion. Our speaker's bio is extensive, as you can see below.
Kenneth E. Kemp, II, practices in the areas of Wills, Trusts, Estate Planning, Probate, Estates, Guardianship, Trust litigation, Probate litigation, Guardianship litigation, Exempt Organizations and Taxation. Ken received his Associate’s Degree in Criminology (Edison Community College, Summa Cum Laude); Bachelor’s Degree in Criminology (Florida Gulf Coast University, Summa Cum Laude); Juris Doctor (J.D., Nova Southeastern University School of Law); and Master of Laws in Taxation (LL.M., University of Miami).
Ken was law clerk at the United States Attorney’s Office, Southern District of Florida, counselling FBI and DEA agents on how to make proper searches and seizures of illicit drugs coming into our ports of entry, and handling high publicity tax-evasion cases. He interned as Assistant State Attorney in the Broward County State Attorney’s Office. After moving to Fort Myers, he joined and later became a partner in Patrone & Kemp, P.A.
Ken has served as adjunct professor at Florida Gulf Coast University, teaching Introduction to Law, Wills, Trusts and Estates, and Business Law, in the Legal Studies program. He has also taught the Trust and Incapacity class of the Florida Guardianship 40 hour course at Florida Southwestern College.
